A Travis County district judge issued a temporary restraining order in response to lawsuits from hemp businesses challenging the regulations.
As a result of the court order, the March 31, 2026, hemp and CBD rules—especially the effective ban on most smokable hemp and the stricter total‑THC threshold—are temporarily not being enforced. The court will consider a longer-term temporary injunction, with a hearing set for April 23, 2026. Stay tuned!
